On 28 December 2002, the Family Law Act was amended to introduce a scheme to split superannuation when married people separate. Amendments to the Family Law Act 1975 from the 1 March 2009 now also provide that de facto couple’s superannuation may be split. However, South Australian and Western Australian de facto couples’ are excluded. That may change if those State Governments agree.

SuperSplitting is a specialist practice and provides advice to other professionals on the effects of relationship breakdown upon superannuation. We are a group of experienced lawyers with expertise in family law and superannuation law, spearheaded by Stephen Bourke.


Stephen is the former head of the Family Law Division of the Commonwealth Attorney-General’s Department. He was project leader for the legislative amendments on superannuation and family law. Stephen Bourke is author of Super Splitting on Marriage Breakdown, published via CCH and an active member of the Self-Managed Superannuation Professionals’ Association of Australia (SPAA).
