The super splitting laws are a complex interaction of 6 other laws:
- The Family Law Legislation Amendment (Superannuation) Act 2001
- The Family Law (Superannuation) Regulations 2001
- The Family Law Legislation Amendment (Superannuation) (Consequential Provisions) Act 2001
- The Superannuation Industry (Supervision) Regulations 2001 No 3 + amendments in the SIS Amendment Regulations 2002 (No 5)
- The Retirement Savings Accounts Amendment Regulations (No 5) 2002.
- The Family Law Legislation Amendment (Superannuation) (Consequential Provisions) Act 2002
Legal Practitioners can enrol in one of two specialist master classes:
- Orders and Agreements: This class describes the pathways through the new super splitting laws and gives worked examples of orders and agreements to obtain the right outcome for your client;
- Valuation and Tax: This class provides the detailed workings of the complex valuation formulas as well as describing the tax law and tax implications of splitting and not splitting superannuation.
